Issue
Where the SSHD is assessing revocation of a sponsor licence based on alleged dishonest conduct, does she need to make an express allegation of dishonesty to the sponsor - so they can make submissions in response - for any corresponding revocation to be procedurally fair?
Facts
J’s Supermarket, a grocery business in Tooting, held a sponsor licence and sponsored two skilled workers as a retail manager and shopkeeper. A Home Office compliance visit in May 2024 found significant discrepancies between the skilled duties stated on their Certificates of Sponsorship and the predominantly shop-floor duties which the employees said they performed. The Secretary of State concluded that the roles were not genuine and had been created to facilitate the workers’ leave to remain. The sponsor licence was suspended and subsequently revoked in October 2024. Following reconsideration, the Secretary of State maintained the revocation, and J’s Supermarket brought a claim for judicial review. Both the claim for judicial review and the appeal were dismissed.
