Issue

Facts
The Appellant was a constable in the Police Service of Northern Ireland. A Police Service Misconduct Panel found him guilty of gross misconduct, consisting mainly of violence perpetrated against a former partner. He was dismissed from the Police Service. The Appellant asserts that the PSNI failed to investigate his allegations of ill-treatment perpetrated by M against him, and that the decision to pursue misconduct proceedings against him whilst ignoring his allegations against M was procedurally unfair and irrational. The Appellant appealed to the Police Appeals Tribunal, which affirmed the decision of the Misconduct Panel. The Appellant applied for judicial review of the Tribunal’s decision. This application was dismissed by the High Court in Northern Ireland. The Appellant then appealed to the Court of Appeal in Northern Ireland, which dismissed his appeal. The Appellant now appeals to the Supreme Court.
