Facts

Following the Stewart Report in 2000, the location of base stations and the processes by which their erection was authorised was an aspect of mobile phone technology which generated a great deal of public concern. Under the Environmental Information Regulations 2004, the Appellant ordered the Respondent to release information regarding these base stations. The Respondent refused and appealed this decision.
